Clarify the question before expanding the examination
A conference can help the instructing team separate the recorded observation from an assertion about identity, conduct or knowledge. It can also explain an existing report, identify further material and refine questions for examination.
The scope, participants and whether advice is to be recorded in writing are agreed in advance. Where an opinion needs to be relied upon in proceedings, the appropriate reporting requirements should be addressed with the instructing solicitor.
